Terms of Service

1. Acceptance of Terms
By accessing or using Westpark (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. Westpark is operated by Westpark LLC (“we,” “us,” or “our”) and is available at westpark.app.
2. Use of the Service
Westpark provides parking predictions for downtown Westport, CT. The Service is intended for personal, non-commercial use. You agree to use the Service in good faith. You may not use the Service to submit false or misleading information, spam, or any content that is abusive, harmful, or illegal.
3. User-Submitted Content
When you submit information about parking conditions, you grant Westpark a non-exclusive, royalty-free, perpetual license to use, aggregate, and analyze it to improve the Service, including checking and improving the predictions. It may be used in aggregated form for research and product improvement. You retain ownership of any identifiable content you submit and may request its deletion at any time by contacting us.
4. Accuracy Disclaimer
Westpark provides parking predictions based on the Town of Westport’s 2024 parking counts, weather data, calendar events, and modeling. These predictions are estimates, not guarantees. We do not guarantee the availability of any parking space. We are not responsible for parking tickets, towing, vehicle damage, or any other consequence of relying on our predictions. Always observe posted signs, time limits, and local parking regulations.
5. Accounts
You don’t need an account to use Westpark. An account, if you have one, holds a first name and email address, and earns points and a tier for your answers to “How full is it?”. Earlier versions of Westpark also gave points for reports and referrals. Points have no monetary value and cannot be redeemed, transferred, or exchanged for cash. We may change or remove them at any time, and we may leave out answers that look inaccurate.
6. Intellectual Property
The Westpark name, logo, design, and all associated software, content, and materials are the property of the operator and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without written permission.
7. Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the data practices described therein.
8. Limitation of Liability
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all liability for any damages arising from your use of the Service, including but not limited to direct, indirect, incidental, consequential, or punitive damages. Our total liability to you for any claim arising from the Service shall not exceed $50.
9. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will note the effective date at the top of this page.
